Until recently, it was always assumed that the mother would get custody of a minor child because of her role as caregiver. But the law is beginning to view fathers also favourably because it feels that the role can now be played equally well by the father. In recent cases, the court has also begun to look at whether the working mother has at all any time for her child and not just the fact that she is capable of supporting her child. According to some legal experts, the situation is now a double edged swordthe mother is denied custody because she is working and again, she is denied custody because she is not economically independent.
Child's DecisionChildren sometimes take their own decision as happened in a case this year, where the child opted to stay with the father because the father had a better lifestyle to offer! Men too feel that they can multitask like a woman and be bread winner and caregiver all in one. Grandparents too are being given custody of a child because they are the ones who are ultimately the caregivers. Women are caught between the fire and the frying pan.
